Terms
Booking
All orders must be made via our online order system including, if applicable, supply of your own internal Purchase Order number. Quotations are subject to confirmation and exclude VAT.
Studio Hire
Studio Hire means the hire of one recording studio including a studio engineer. Studio Hire also includes any reasonable telephone or ISDN costs made in relation to the work being carried out in addition to emailing of audio mp3 or video .mov copies and up to two copies on CD or DVD. Over-runs are charged pro-rata in 30 minute increments. Clients are responsible for all music licensing clearances and payments.
Commercials
Studio time for recording and production of commercial will be confirmed when approved script is received from client. Client may make any changes to script up to time of recording. Any changes after recording requiring the attendance of voiceover artist(s) will be treated as a new commercial and charged accordingly. Any changes after recording not requiring attendance of voiceover artist(s) will be treated as an edit and charged at studio hire rate.
Final checking, proofing and approval for production is the responsibility of the client and no liability remains with Digital Audio Productions for any errors or omissions in work so approved. With this in mind we stress that you take an adequate amount of time before final sign off.
Cancellation
Cancellations made within 24 hours of scheduled booking will incur a cancellation fee equal to 50% of studio hire charge. Cancellations made within four hours of scheduled booking will incur a cancellation fee equal to 100% studio hire charge. If, for any reason, the client decides to terminate during any stage, the fee and expenses for all work up to and including that stage will become payable.
Payment
All invoices presented by Digital Audio Productions are due within 30 days. Overdue invoices may be subject to 1% above prevailing Bank of Ireland interest rate. Invoices outstanding after 90 days will be surrendered to a Credit Control company for collection of monies and client will be responsible for any costs incurred in recovering money owed.
Invoices presented to Digital Audio Productions are generally settled within thirty days. Invoices presented to Digital Audio Productions received 90 days or later after the final completion of the service or facility provided will not be paid.
Backup
All projects are backed up and stored for 6 months at no additional charge. However due to the very nature of digital media and the sensitiveness to climatic conditions, we give no guarantees and accept no liability whatsoever for any loss or damage to any digital files or information.
Confidentiality
Digital Audio Productions shall treat all knowledge of the client’s intentions, production methods and business organisation as confidential and shall not, at any time, divulge such information without the written consent of the client. Digital Audio Productions will not divulge any information relating to or arising from the work carried out in relation to it unless or until such information lawfully comes into the public domain.
Law
These Terms and Conditions shall be governed by Irish Law and the Courts of Law of the Republic of Ireland shall have jurisdiction to entertain any action in respect hereof or any case stated by the Arbitrator. The failure of any party to enforce its rights under this Agreement at any time for any period shall not be construed as a general waiver of such rights. If any provision or part of any provision of these Terms & Conditions are found by a court or other competent authority to be void or unenforceable, such provision or part of a provision shall be deleted from these Terms and Condtions and the remaining provisions or parts of the provision shall continue to full force and effect.
